STATUTE
Definitions Used in the Terms and Conditions:
Entrepreneur – a legal entity conducting business activities in its own name, including Tulilab Klaudia Bakalarz (hereinafter referred to as “Tulilab”).
Buyer – any entity placing an Order in the Online Store (either a Consumer or a non-Consumer individual/entity).
Consumer – a natural person entering into a legal transaction with the Entrepreneur (including a sales contract) not directly related to their business or professional activity (hereinafter also referred to as “Client”).
Online Store (Store) – an online platform through which the Client can, in particular, place Orders.
Complaint – a procedure applied in the case of discovering a defect in the sold product.
Warranty – a procedure for pursuing liability from the Entrepreneur who sold a product to a Consumer in the event of discovering a physical or legal defect.
Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);
Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827);'
Act on the Provision of Electronic Services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204 as amended);
Product – any item available for sale in the Online Store.
Material Defect – a basis for the Consumer to exercise certain rights under the warranty.
Information Document – a document attached to the Product informing the Consumer about how to use the product.
Online Store – the website owned by Tulilab Klaudia Bakalarz, where the Order was placed by the Buyer.
Order – the Buyer’s declaration of intent to conclude a distance sales agreement via the Online Store, specifying at least the type and quantity of Products.

These Terms and Conditions define the rules for using the Online Store available at www.tulilab.pl, owned by Tulilab Klaudia Bakalarz, ul. Czernichowska 63, 32-060 Liszki, registered in the Central Register and Information on Economic Activity, NIP 9442168511, REGON 528768347.

The Terms and Conditions define the principles for concluding and performing sales contracts for Products available in the Online Store.

Use of the Online Store is possible with a device providing internet access, email, and a web browser.

The content of the Online Store does not constitute an offer under the Civil Code; placing an order by the Client does not constitute immediate contract conclusion.

Orders placed on the website for products presented by Tulilab constitute only an invitation to make a purchase offer. A sales agreement is concluded upon confirmation of the order by Tulilab via email. Until the Client receives this confirmation, they may cancel the order.

Tulilab makes every effort to ensure that the photos, descriptions, and technical data of the Products are accurate. All products in the Store are handmade and may slightly differ from the images.

Tulilab is the manufacturer of the Products.

In matters not regulated by these Terms, the generally applicable laws apply, including the Civil Code and the Consumer Rights Act.

These Terms do not exclude or limit any rights of the Consumer granted under mandatory legal provisions. In case of any conflict, the statutory provisions shall prevail.
Product Prices and Payment Methods

All product prices are in Polish złoty (PLN) and include all applicable taxes, including VAT.

Shipping costs are added to the product price and are covered by the Consumer. Orders over 300 PLN qualify for free shipping.

Shipping cost depends on the delivery method chosen by the Consumer and is added to the order total.

Orders via www.tulilab.pl are accepted electronically 24/7.

The Client selects Products by adding them to the cart. Until the order is submitted, the Client may modify their details and the Product selection.

The Seller is obliged to deliver a Product free from physical or legal defects.

A contract is concluded when the Seller accepts the order, confirmed via email within 48 hours.

Orders paid via bank transfer or electronic payment are processed after payment is received, no later than 7 working days after payment confirmation.

For custom-made Products (e.g., personalized with a name or made-to-order items), processing time may be extended and is determined individually with the Client.

If a Product is unavailable, the Client will be informed immediately and may change the order, accept a longer delivery time, or cancel the order and receive a full refund.

The Buyer must provide a valid phone number and email address when placing the order.

Incorrect data may prevent successful order fulfillment and delivery.
Shipping

Products are delivered within Poland via InPost parcel lockers to the location indicated by the Consumer.

Delivery costs are covered by the Consumer unless the total order exceeds 300 PLN.

Orders above 300 PLN qualify for free shipping.

In case of visible shipment damage, it is recommended that the Buyer prepare a damage report with the courier and immediately inform the Seller.
Returns

The Consumer has the right to withdraw from the contract within 14 days without giving any reason, except for return shipping costs as outlined in the Consumer Rights Act.

The withdrawal period expires 14 days from the date of receipt.

To exercise the right of withdrawal, the Consumer must notify us via email at tulilabhandmade@gmail.com with a clear statement.

In the event of withdrawal, the Seller will return all payments received, including delivery costs (excluding extra charges for non-standard delivery), no later than 14 days after being informed. The refund will be made using the same payment method unless agreed otherwise.

The Consumer must return the Product to Tulilab Klaudia Bakalarz, ul. Czernichowska 63, 32-060 Liszki, within 14 days of informing the Seller. The Consumer bears the cost of returning the Product.

The Seller may refuse returns of used, damaged, or incomplete Products.

The right of withdrawal does not apply to custom-made or personalized items.
Complaints

The Seller is obliged to deliver goods free from defects.

All Products purchased are covered by a two-year warranty under the Civil Code and Consumer Rights Act.

Complaints will be reviewed within 14 days of submission.

The complaint should include a description of the defect, relevant circumstances, the Client’s request, and current contact details.

Refunds, if required, will be made via the original payment method unless agreed otherwise.

If replacement or repair is necessary, or the complaint is rejected, the Seller will return the Product via courier to the address indicated by the Consumer.
